T E R M S   &   C O N D I T I O N S   ​

Please ensure that you have read and agree to the following Terms & Conditions before placing your order with The Berkshire Bakesmith. By placing an order with The Berkshire Bakesmith, you agree that you have read, understood and accept the following Terms & Conditions

• By paying a Booking Payment to secure your booking with The Berkshire Bakesmith, you are confirming your acceptance of these Terms & Conditions
  
• You understand that your order is not confirmed and is not deemed to be fully booked until such times as your Booking Payment has been paid and your order has been confirmed in writing by The Berkshire Bakesmith
  
• You understand that your Booking Payment is non refundable if you cancel your order for any reason, either on or before collection or delivery of your order
• You understand that in the unlikely event your order needs to be cancelled by The Berkshire Bakesmith for reasons beyond control, your Booking Payment will be refunded to you in full. The only exception to this is in the event of you agreeing to The Berkshire Bakesmith transferring your order to another trusted, professional local cake maker, in which case your Booking Payment will be transferred to the cake maker completing your order
  
• You understand that The Berkshire Bakesmith reserves the right to terminate immediately your order if you behave in a way that is deemed to be inappropriate or offensive and in this event, your Booking Payment will not be refunded to you
• You understand that if you do not pay the balance of your order in full, on or before collection or delivery of your order, or on or before the date stated on your Order Agreement, your order will remain the property of The Berkshire Bakesmith and your Booking Payment will not be refunded to you
• You understand that if you are requesting The Berkshire Bakesmith to replicate a design from a photograph, the design you receive will have differences to the image supplied. The Berkshire Bakesmith does not directly copy another cake artist's design. The design you receive may be similar to the photograph you supply, but will not be an exact copy. The only exception to this is if you are providing a photograph of a cake that was designed by The Berkshire Bakesmith, in which case a very close copy of the design will be created but you accept that some differences may occur as each design is handmade
• If you are placing an order for a gluten free, dairy free, egg free, nut free or vegan cake, or any other cake being made to cater for a specific dietary requirement, you understand that although your cake will not directly contain these products, you also understand that whilst every care is taken to avoid any cross contamination with these products, The Berkshire Bakesmith cannot guarantee with 100% certainty that there will be no traces of these products present due to the ingredients being present in the kitchen
  
• Collection of your cake from The Berkshire Bakesmith's premises is by prior appointment only. Collections can be arranged between 9am and 3pm or from 7pm - 9pm Monday to Thursday. Collections can be arranged between 9am and 3pm on Fridays. Weekend collections are strictly arranged between 9.30am and 11am. There occasionally is some flexibility on the available times depending on The Berkshire Bakesmith's commitments on any particular date or time and this should be discussed at the time of booking. 
  
• You understand that if any additional Terms & Conditions apply to your booking, you will be notified of these separately. Any additional Terms & Conditions are in addition to those included here unless otherwise stated.
  
• You understand that all competitions run by The Berkshire Bakesmith will have separate and/or additional Terms & Conditions of entry as per the competition rules advertised. The Berkshire Bakesmith's decision will be final in respect of any disputes arising over competition entry eligibility.
  
• The Berkshire Bakesmith has a separate Privacy Policy which is also shown on the website for your information.
  
• The Berkshire Bakesmith has a separate Complaints Policy shown on the website which details how complaints are handled. Confirming your booking is acceptance of the Complaints Policy.
